When asked what symptoms can show someone with a blood alcohol level of 0.135%, Dr. Rosenbaum said: “ It can correlate -with confusion, it can correlate with the loss of memory or the deterioration of memory, in relation to the events prior to events when I see them at the ER, with a level of 135.
Dr. Rosenbaum said to the court: “Alcohol is what we call sedative hypnotic. They deteriorate cognition, deteriorates memory, deteriorates people’s ability to process information. In my experience, in patients with levels in this 135 region, memory is frequently damaged.”
The doctor continued that in patients he has previously dealt with a blood alcohol level of 0.135% or “135” he has observed, “confusion” and “larile behaviors”.
“In people who are alcohol intolerant or who do not drink frequently, with this level of alcohol, it can be a notable presentation in terms of modifying their mental state and cognition.”
The defense asked the doctor about retrograde extrapolation, a method used to estimate a person’s blood alcohol level at a specific time in the past based on a BAC’s subsequent test result.
Dr. Rosenbaum testified that he had made a retrograde extrapolation for this case, and made a “reasonable assumption” that the blood alcohol level of the alleged victim was between “twice three times the legal limit”, about four hours before presenting it.
It was during this time that the alleged victim says he was raped by Crosbie in a hotel room at the Omni Parker House Hotel. She says that after returning to the room to have sex consensus with the man with whom Crosbie shared a hotel room, he claims that he woke up Crosbie assauling -sexually.
