In a motion to dismiss, the city said that Mayor Jon Mitchell had a “reason of good faith” to begin completion procedures against Coderre, adding that the court review of the Civil Service’s decision was still ongoing.
The city’s motion says that the estate did not show that the call for the Civil Service’s decision was “for an ultre -altregulated or illegitimate purpose.”
“The plaintiffs have problems with the content of the Call and the effect on readers,” the presentation says.
On Tuesday, an audience is planned on the demand for illicit death in the Supreme Court of Bristol.
The estate has also filed a separate demand from “Dram Shop” in the same court, where he names the Bayside Lounge, his manager and the employee who served as Coderre on the day of his death as defendants.
